1. The Owner

2. Acceptance of the terms

Accessing the Site and using the digital services offered (consulting the menu, the "Virtual Waiter Vicky" quiz, newsletter subscription, interaction with our official social media channels) constitutes full acceptance of these Terms of Use and of the Privacy Policy.

Users who do not accept these terms are asked not to use the Site or the related services.

3. Scope of the service

The Site is primarily informational and promotional in nature and makes available, free of charge:

• information about Bar Vittoria's gelato and pastry business;
• the complete digital menu with allergens and prices;
• the "Virtual Waiter Vicky" service: a conversational assistant based on artificial intelligence that suggests menu items according to the preferences provided by the user;
• content published automatically or manually on the official Instagram and Facebook channels (@bar_vittoria), through authorised applications provided by Meta Platforms Ireland Ltd.;
• contact tools (email form, WhatsApp, telephone).

4. Permitted use and restrictions

The user undertakes to:

• use the Site solely for lawful and personal purposes;
• not interfere with the proper functioning of the Site nor attempt to access restricted areas;
• not reproduce, distribute or publish the Site's content without the written authorisation of the Owner;
• not use automated tools (bots, crawlers) to extract data in bulk, except for the web spiders of search engines that comply with the robots.txt file.

5. Intellectual property

All the content on the Site — including texts, images, photographs, logos, recipes, trade marks, videos, graphic layout and source code — is the exclusive property of Bar Vittoria S.a.s. or of the respective rights holders and is protected by the applicable legislation on copyright, trade marks and industrial property.

Any reproduction, in whole or in part, without the prior written authorisation of the Owner is prohibited.

6. Virtual Waiter Vicky (AI service)

The "Virtual Waiter Vicky" service available at /en/quiz.html uses a third-party artificial intelligence model (Anthropic Claude) to generate personalised suggestions based on the answers provided by the user to a short questionnaire.

The suggestions are purely indicative and do not constitute nutritional, medical or any other kind of advice. Any allergies and intolerances remain the responsibility of the user and must be reported to staff at the time of ordering; for the complete list of allergens, please refer to the Allergens section of the menu.

The service is subject to daily usage limits to prevent abuse. The Owner reserves the right to suspend or restrict access in the event of improper use.

7. Integration with Meta platforms (Facebook / Instagram)

Bar Vittoria uses authorised applications provided by Meta Platforms Ireland Ltd. to manage and publish content on its official channels @bar_vittoria (Instagram) and Bar Vittoria (Facebook), as well as to display the latest Instagram posts within the Site via Meta's official API.

The user's interactions with such content (likes, comments, direct messages) are governed by Meta's terms of use and not by those of Bar Vittoria. To request the erasure of any personal data processed in that context, please refer to the Erasure of personal data section of the Privacy Policy.

8. Limitation of liability

The Owner undertakes to ensure the utmost accuracy of the information published. However, prices, product availability and opening hours are subject to change without notice; what is provided in store at the time of ordering shall prevail.

The Owner is not liable for any temporary interruptions of the Site due to maintenance, malfunctions of the hosting provider (Aruba S.p.A.), events of force majeure or causes not attributable to the Owner.

Links to third-party websites on the Site are provided for the user's convenience: the Owner neither controls nor is responsible for the content, policies or practices of third-party sites.

9. Changes to the terms

The Owner reserves the right to amend these Terms of Use at any time, including as a result of regulatory changes or developments in the services offered. Changes take effect from the moment they are published on the Site; the updated version will always be available on this page.

10. Governing law and jurisdiction

These Terms of Use are governed by Italian law. For any dispute relating to their interpretation, performance and validity, the Court of Catanzaro shall have exclusive jurisdiction, without prejudice to the application of the mandatory provisions protecting consumers.
